29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about December 3, 2020, each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were they provided with an alternative fall protection measure: A. Employees were working from the top of the second story of a new residential apartment construction. Employees were exposed to falling approximately 10 to 20 feet. B. An employee was working near an unguarded window opening on the second story of a new residential apartment construction. The employee was exposed to falling approximately 10 feet to ground level.
