1904.5(a) Basic requirement. You must consider an injury or illness to be work-related if an event or exposure in the work environment either caused or contributed to the resulting condition or significantly aggravated a pre-existing injury or illness. Work-relatedness is presumed for injuries and illnesses resulting from events or exposures occurring in the work environment, unless an exception in �� 1904.5(b)(2) specifically applies. Location: 19 Varnum Street, Lowell, MA On or about August 20, 2020, the employer did not record the following workplace injuries or illness of the OSHA form 300 or equivalent for the calendar year 2020: a) On or about May 24, 2020 at CareOne at Lowell: an employee, a nurse supervisor, died on May 23, 2020, after exposure to SARS-CoV-2 (the virus that causes COVID-19). The employer did not record the fatality on its OSHA 300 form or equivalent in circumstances where COVID-19 was prevalent in the employee's local community and in the facility.
