29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: A) M.L.S. Builders, LLC, conducting work at 19 Winfield Manor Court, Perrysburg, OH 43551: On or about July 1, 2020, the employer did not ensure that employees were protected from fall hazards while conducting construction activities atop the multiple levels of the two story residential structure. Employees did not use fall protection and were exposed to the fall hazards of approximately 11 to 18 feet from the multiple levels of the structure to the ground below. M.L.S. Builders, LLC was previously cited for a violation of this Occupational Safety and Health Standard (29 CFR 1926.501(b)(13)), which was contained in OSHA Inspection # 1361781, Citation number 1, Item number 3, and was affirmed as a final order on 03/19/2019, with respect to a workplace located at 460 Cantbury Blvd., Perrysburg, OH 43551. M.L.S. Builders, LLC was previously cited for a violation of this Occupational Safety and Health Standard (29 CFR 1926.501(b)(13)), which was contained in OSHA Inspection # 1060031, Citation number 1, Item number 2, and was affirmed as a final order on 05/19/2015, with respect to a workplace located at 276 Tiberon Trace, Wadsworth, OH 44281.
