29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form. Where the employer could not identify or reasonably estimate the employee exposure, the employer did not consider the atmosphere to be IDLH: On, or about February 20, 2020, and at times prior to, at the location of 8101 Union Ave., CLEVELAND, OH, 44105, in the hazardous materials bay, the employer failed to evaluate exposure to methyl ethyl ketone (MEK) when employees, such as mechanics, working in bay areas near the hazardous materials bay, complained of chemical exposure.
