OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to fall, struck-by and crushed-by hazards from structural collapse: a. On or about January 17, 2020 and at times prior, at the commercial construction site in Davenport, Florida. The employer did not assure that the eighty-nine 59-foot, 11.25 inches span common trusses weighing about 41,064 lbs. were adequately braced to prevent shifting and/or collapsing. As temporary lateral restraint, four parallel lines approximately 10-14 feet apart consisting of 25.5 inch wooden spacers crossing the trusses and one parallel line consisting of 16-foot wood pieces (with 1in. overlap each side) crossing trusses along the north side elevation were installed. Temporary diagonal bracing was not installed. b. On or about January 17, 2020 and at times prior, at the commercial construction site in Davenport, Florida. The employer allowed employees to setup two hip sets of 59-foot, 11.25 inches span with 11-foot setbacks weighing about 2,358 lbs. without adequate bracing to prevent shifting and/or collapsing. As temporary restraint, two parallel lines composed of 16-foot wood pieces (with 1in. overlap each side) crossing the hip jacks were installed. Only a few nails of the truss anchor for the plies of the Hip-Set to the bearing supports were nailed and the HIP-Sets missed the corner jacks prior to installing common trusses. c. On or about January 16, 2020 at worksite located at the commercial construction site in Davenport, Florida. The employer used a 16-foot long spreader bar to fly and set eighty-nine 59-foot, 11.25 inch span common trusses weighing about 41,064 lbs. and two hip sets of 59-foot, 11.25 inch span with 11-foot setbacks weighing about 2,358 lbs. Pursuant to 29 CFR 1903.19, abatement certification and documentation is required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
