29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): (a) Production - On or about June 25, 2019, the employer failed to ensure that point of operation guarding was installed to prevent employees from having any part of their body on the Accupress #13 press brake when actuating the machine with a foot pedal. An employee suffered a severe occupational injury which resulted in the amputation of five digits between two hands. The light curtains on the press brake had been disabled and no additional guarding was put in place. (b) Production - On or about June 27, 2019, the employer failed to ensure that point of operation guarding was installed to prevent employees from having any part of their body on the Accupress Press Brake #1, Serial # 7102 when actuating the machine with a foot pedal. The light curtains on the press brake had been disabled and no additional guarding was put in place. (c) Production - On or about June 27, 2019, the employer failed to ensure that point of operation guarding was installed to prevent employees from having any part of their body on the Accupress Press Brake #2 Serial #7098 when actuating the machine with a foot pedal. The light curtains on the press brake had been disabled and no additional guarding was put in place. (d) Production - On or about June 27, 2019, the employer failed to ensure that point of operation guarding was installed to prevent employees from having any part of their body on the Accupress Press Brake #5, Serial # 7107 when actuating the machine with a foot pedal. The light curtains on the press brake had been disabled and no additional guarding was put in place. (e) Production - On or about June 27, 2019, the employer failed to ensure that point of operation guarding was installed to prevent employees from having any part of their body on the Accupress Press Brake #9, Serial # 7099 when actuating the machine with a foot pedal. The light curtains on the press brake had been disabled and no additional guarding was put in place. (f) Production - On or about June 27, 2019, the employer failed to ensure that point of operation guarding was installed to prevent employees from having any part of their body on the Accupress Press Brake #10, Serial # 7101 when actuating the machine with a foot pedal. The light curtains on the press brake had been disabled and no additional guarding was put in place. (g) Production - On or about June 27, 2019, the employer failed to ensure that point of operation guarding was installed to prevent employees from having any part of their body on the Accupress Press Brake #14, Serial # 6604 when actuating the machine with a foot pedal. The light curtains on the press brake had been disabled and no additional guarding was put in place. (h) Production - On or about June 27, 2019, the employer failed to ensure that point of operation guarding was installed to prevent employees from having any part of their body on the Accupress Press Brake #15, Serial # 6874 when actuating the machine with a foot pedal. The light curtains on the press brake had been disabled and no additional guarding was put in place. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.
