29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident: An employee operating a powered industrial truck was involved in an accident on 6/20/19 where the operator struck a bin in the aisle. The employee continued to work for five shifts without being retrained. On 6/25/19, the same operator struck an object in an aisle way with the Yale Model No. NTA035SB S/N B869T01840M resulting in the need for a supervisor to restart the equipment. Several minutes later the same employee struck a worker in aisle way 21/22 resulting in injuries requiring hospitalization. The employer failed to provide refresher training to the operator post-accident on 6/20/19 and 6/25/19 as required prior to allowing the employee to continue to operate the powered industrial truck.
