29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition: The employer is failing to protect employees from a struck-by hazard in that a forklift was being operated in an unsafe condition and not taken out of service. This was most recently observed at 71045 NE 50, Pawnee City, Nebraska where a forklift was being operated without a non-slip surface on its brake pedal.
