29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: The employer is failing to protect employees from engulfment hazards associated with trenching and excavations. This was most recently documented on or about February 14, 2019 at a jobsite located at or near: Ivyleigh Court, St. Charles, Missouri. The employer did not provide or require the use of a benching, sloping, shoring or other means to ensure that employees working in excavations were protected from cave-in hazards. The unprotected trench ranged in depth from 13.0-14.0 feet, with near vertical walls.
