29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system, nor are employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) Aspen Contracting Inc., as a controlling employer, is failing to ensure that subcontracted workers are protected from fall hazards while working on residential roofs. This violation was most recently observed on July 18, 2018 at 7246 Josh Byers Way, Fountain, Colorado, when employees of J Cuellar, LLC (subcontractor) were exposed to falls in excess of six feet while performing roofing work without any form of fall protection. Aspen Contracting, Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1277041, citation number 1, item number 1, and was affirmed as a final order on February 22, 2018 with respect to a workplace located at 2818 Eagle Hills Cir, Papillion, NE 68133.
