29 CFR 1926.501(b)(13): The employer does not ensure that each employee(s) engaged in residential construction activities 6 feet or more above lower levels are protected by a guardrail system, safety net system, or personal fall arrest system, or provided with an alternative fall protection measure under another provision of paragraph (b): a. Site - Employees performing framing activities on the second floor level are exposed to interior falls of approximately 10 feet and exterior falls of approximately 15 feet where fall protection is not utilized. The employer routinely fails to assure effective protection against falls as required by the standard, as demonstrated on December 14, 2017, when employees working from the second floor as they performed framing activities were exposed to a falls of 10 feet and 15 feet where personal fall arrest equipment was not utilized at 30 Lamer Ave, Rye, New Hampshire. b. Site - Employees clearing ice and snow on the second floor level are exposed to interior falls of approximately 10 feet and exterior falls of approximately 15 feet where fall protection is not utilized. The employer routinely fails to assure effective protection against falls as required by the standard, as demonstrated on December 14, 2017, when employees working from the second floor as they cleared ice and snow were exposed to a falls of 10 feet and 15 feet where personal fall arrest equipment was not utilized at 30 Lamer Ave, Rye, New Hampshire. c. Site - Employees using a caulking gun on the second floor level are exposed to interior falls of approximately 10 feet and exterior falls of approximately 15 feet where fall protection is not utilized. The employer routinely fails to assure effective protection against falls as required by the standard, as demonstrated on December 14, 2017, when employees working from the second floor as they used a caulking gun were exposed to a falls of 10 feet and 15 feet where personal fall arrest equipment was not utilized at 30 Lamer Ave, Rye, New Hampshire. Clint Forrest d/b/a CFA Builders previously committed a willful violation of this standard on November 10, 2015, with respect to a workplace located at The Residences at 27 Chestnut Street, Exeter, NH 03833 which was contained in OSHA inspection number 1105983. Clint Forrest d/b/a CFA Builders previously committed a serious violation of a similar standard on April 24, 2015, with respect to a workplace located at 49 Main Street, Durham, NH which was contained in OSHA inspection number 1058529
