Text For Citation: 02 Item/Group: 001 Hazard:
29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition: On or about June 29, 2017, employees were exposed to struck-by hazards due to the following: a. Hyster #2 had not been taken out of service even though the daily inspection sheets had indicated problems with head/tail lights and backup alarm/horn on June 28 (first and second shifts), June 27 (first and second shifts), June 26 (first and second shifts), June 23 (first shift), June 22 (first and second shifts), June 21 (first and second shifts), June 20 (first shift), and June 19 (first shift). The inspections also indicated problems with operating levers/controls on June 19 (first shift), June 20 (first shift), June 21 (first and second shift), and June 22 (first shift). b. Hyster #3 had not been taken out of service even though the daily inspection sheets had indicated problems with the head/tail lights (no head lights and no brake lights) during the weeks of June 19 and June 26. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records. The employer was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 567604, citation number 1, item number 1 and was affirmed as a final order on 10/17/2012, with respect to a workplace located at 509 Bankhead Highway, Winder, GA 30680.
