29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: The employer failed to evaluate all of its workplace at 4901 Elysian Fields Road, Marshall, Texas to identify all permit spaces on the premises. The employer did not evaluate all areas of its facility either by physical inspection or by review of documentation. As a result, the employer never identified the spaces identified below as permit-required confined spaces: (a) On or about April 14, 2017, and times prior thereto at Plant #3- Tunnel Kiln-elevator; employees entered this permit required confined space to perform work, exposing employees to hazardous conditions within the space. (b) On or about April 14, 2017, and times prior thereto at Plant #3- Roller Kiln-elevator; employees entered this permit required confined space to perform work, exposing employees to hazardous conditions within the space. (c) On or about April 16, 2017, and times prior thereto at Plant #3- Tunnel Kiln; employees entered this permit required confined space to perform work, exposing employees to hazardous conditions within the space. (d) On or about April 14, 2017, and times prior thereto at Plant #3- Roller Kiln Dryers; employees entered this permit required confined space to perform work, exposing employees to hazardous conditions within the space. (e) On or about April 14, 2017, and times prior thereto at Plant #3- Clay Silos and Bins; employees entered this permit required confined space to perform work, exposing employees to hazardous conditions within the space.
