29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: 1. On or about March 3, 2017, the employer failed to ensure that employees working on top of the cranberry dryer were protected against falling from the top of dryer exposing the employees to a fall hazard of 12 feet 9 inches to the concrete ground below. 2. On or about March 3, 2017, the employer failed to ensure that employees working on top of the centrifuges were protected against falling exposing the employees to a fall hazard greater than 4 feet to the lower level.
