29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. Location: 9 Norwalk Avenue, Westport, CT 06880 The carpenter bracket scaffold 35 feet above ground level located on the south side of the residential construction site that the employees were working from was not equipped with a fall protection system. On or about 4 December 2016, two workers were working from a carpenter bracket scaffold at a residential construction site in Norwalk, CT. One of the 2x6 support brackets dislodged from the side of the building when the nails holding it in place pulled out from the wall. The 2x12 plank the workers were standing on subsequently and simultaneously shifted, fell a couple of feet, and rested on a lower level. This resulted in both workers losing their balance resulting in both workers falling to the ground 35 feet below. One worker was fatally injured and the other worker sustained severe bodily injuries.
