29 CFR 1926.352(c): Welding or heating was done where the presence of other flammable compounds creates a hazard. In the Alternative 29 CFR 1910.252(a)(2)(vi)(C): Employer did not ensure that cutting or welding were not permitted in the presence of explosive atmospheres (mixtures of flammable gases, vapors, liquids, or dusts with air), or explosive atmospheres that may develop inside uncleaned or improperly prepared tanks or equipment which have previously contained such materials. The employer did not ensure that welding was not conducted in the presence of flammable compounds (mixtures of flammable gases, vapors, liquids). This violation occurred on or about August 12, 2016, on the Sunoco Seaway Header at the Sunoco Logistics Plant in Nederland, Texas, when employees were instructed to weld and grind on an un-cleaned Pipe Header which had previously contained flammable chemicals such as crude oil.
