29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a. At the jobsite, the foreman did not provide cave-in protection for an employee who was using a shovel to remove soil from under a storm drain pipe in a trench with type "C" soil which was 6 feet 7 inches deep, 6-7 feet wide, and 36 feet 10 inches long, on or about 8/9/16.
