29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Worksite - The employer does not ensure that appropriate fall protection equipment or methods are in use. This violation was most recently observed at 1325 Chelsea Drive, Bethlehem, PA on June 22, 2016, when employees engaged in framing work were accessing unprotected edges of the north side second floor via an extension ladder, without utilizing any means of fall protection. The employer's ongoing obligation is to ensure that the necessary fall protection equipment and/or methods are in use for the duration of the fall hazard. b) Worksite - The employer does not ensure that appropriate fall protection equipment or methods are in use. This violation was most recently observed at 1325 Chelsea Drive, Bethlehem, PA on June 22, 2016, when employees engaged in framing work accessing unprotected edges of the north side third floor via an extension ladder, approximately nine feet above the lower level, without utilizing any means of fall protection. The employer's ongoing obligation is to ensure that the necessary fall protection equipment and/or methods are in use for the duration of the fall hazard. c) Worksite - The employer does not ensure that appropriate fall protection equipment or methods are in use. This violation was most recently observed at 1325 Chelsea Drive, Bethlehem, PA on June 22, 2016, when employees engaged in framing work accessing unprotected edges of the south side second floor via an extension ladder, approximately nine feet above the lower level, without utilizing any means of fall protection. The employer's ongoing obligation is to ensure that the necessary fall protection equipment and/or methods are in use for the duration of the fall hazard. d) Worksite - The employer does not ensure that appropriate fall protection equipment or methods are in use. This violation was most recently observed at 1325 Chelsea Drive, Bethlehem, PA on June 22, 2016, when employees engaged in framing work accessing while working on the frame members of trusses, approximately between nine feet above the lower level, without utilizing any means of fall protection. The employer's ongoing obligation is to ensure that the necessary fall protection equipment and/or methods are in use for the duration of the fall hazard. e) Worksite - The employer does not ensure that appropriate fall protection equipment or methods are in proper use. This violation was most recently observed at 1325 Chelsea Drive, Bethlehem, PA on June 22, 2016, when employees engaged in framing work were working on the second floor top plate, approximately 9 to 33 feet above a lower level, without utilizing any means of fall protection. The employer's ongoing obligation is to ensure that the necessary fall protection equipment and/or methods are in use for the duration of the fall hazard.
