Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Water Line Tyian- Employees operated a Hatachi Excavator EX-200, to excavate and install water lines. Nuts, bolts and rebar were modified and used as pins for the shovels instead of the pins originally provided by the manufacturer to secure the shovel. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARD IS: 1.To follow the Association of Equipment Manufacturers (AEM) "Safety Manual for Operating and Maintenance Personnel" which requires that damaged and missing parts are repaired or replaced, and 2.To follow the Manufacturer's Operator Manual by using only service parts meeting manufacturer specifications, and 3.To train operators and maintenance personnel to inspect equipment for defects and to complete service and repairs before equipment is placed back in service. KORANDO CORPORATION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR EQUIVALENT STANDARD SECTION 5(a)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970 WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 307375691, CITATION NUMBER 1, ITEM NUMBER 1, ISSUED ON 07/22/2004, WITH RESPECT TO A WORKPLACE LOCATED AT HIGHWAY PROJECT, DEDEDO, GUAM.
