29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: The employer does not provide a stairway, ladder, ramp or other safe means of egress to each employee when working in a trench approximately 6.2 feet deep. a) This most recently occurred on March 10, 2016, at 1632 N. Western Ave., Chicago, Illinois. Employees are not provided with a safe means of egress when working in a trench approximately 6.2 feet deep. To abate this hazard in the future, the employer must ensure that safe means of access and egress is provided to employees when working in the trench, and that no employees enter the trench until the safe means of access/egress is provided. This employer has been cited for this practice that included: OG Plumbing LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 962359, citation number 2, item number 1 and was affirmed as a final order on July 23, 2014, with respect to a workplace located at 3624 N. Janssen Ave., Chicago, IL 60613. This employer has been cited for this practice that included: OG Plumbing LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 767522, citation number 1, item number 1 and was affirmed as a final order on January 31, 2013, with respect to a workplace located at N. Damen Ave. & W. Erie St., Chicago, IL 60622. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect it's employees so that a safe means of access/egress is provided while working in excavations.
