29 CFR 1926.65(h)(4): After the actual clean-up phase of the hazardous waste operation commenced, the employer did not monitor those employees likely to have the highest exposures to hazardous substances and health hazards likely to be present above permissible exposure limits or published exposure levels by using personal sampling frequently enough to characterized employee exposures: (a) On and after 01/18/2016, at GE Power, Building 5, 4E floor, for the laborers removing debris by hand and using HEPA vacuums and mercury vacuums to remove hazardous materials such as, but not limited to, elemental mercury, soil contaminated with mercury and wood contaminated with mercury. The employer did not perform personal monitoring. (b) On and after 05/04/2016, at GE Power, Building 5, 3E floor, for the laborers removing debris by hand and using HEPA vacuums and mercury vacuums to remove hazardous materials such as, but not limited to, elemental mercury, soil contaminated with mercury and wood contaminated with mercury. The employer did not perform personal monitoring. (c) On and after 01/18/2016, at GE Power, Building 5, 4E floor, for the laborers removing debris by hand and using HEPA vacuums and mercury vacuums to remove hazardous materials such as, but not limited to, arsenic, soil contaminated with arsenic and wood contaminated with arsenic.
