OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards in areas where the concrete decking (ceiling) was delaminating and spalling. a. On or about December 3, 2015, in the storage mezzanine near the skybox and the employee walkway adjacent to this area, the employer did not protect employees from debris falling from the ceiling. There were several large irregular rectangular like pieces of concrete delaminating and spalling from the ceiling. The employer had not installed any overhead protection to protect employees from struck-by hazards due to the falling concrete. b. On or about December 3, 2015, in the M149-M151 mens locker and the Delivery Bar Code Sorter area, DBCS-1, the employer did not protect employees from debris falling from the ceiling. There were several large irregular rectangular like pieces of concrete delaminating and spalling from the ceiling. The employer had not installed any overhead protection to protect employees from struck-by hazards due to the falling concrete. c. On or about March 15, 2016, in the Advanced Facer Canceler System area, AFCS-1, the employer did not protect employees from debris falling from the ceiling. There were several large irregular rectangular like pieces of concrete delaminating and spalling from the ceiling. The employer had not installed any overhead protection to protect employees from struck-by hazards due to the falling concrete.
