Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to rotating amusement ride parts at the Tornado ride when in the ride access area: On or about August 20, 1999 a ride attendant at the Scrambler/Tornado amusement ride, a ride which operated in the dark and in fog while enclosed in a building, was fatally injured when he was struck by a portion of the moving ride when he was in the ride access area. Feasible abatement methods may include but are not limited to: 1.Installation of engineering controls to prevent employees from being exposed to the points of danger of the moving ride. 2.Implementation of administrative controls to assure compliance with the employer's rules and procedures. 3. Removing the ride from use.
