Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazard of falling into a dumb waiter shaft and or being caught between descending or ascending power dumb waiter car and shaft wall due to the hoistway door not functioning and the safety interlock bypassed as required. a)Kitchen Dumb Waiter - On or about 12/16/94. Among other methods, one feasible and available method to correct these hazards is the repair of the hoistway unit system, including door interlocks. This feasible method is listed in the following reference: Reference: American Standard Safety Code for Elevators, Dumbwaiters, and Escalators. A17.3 1993 section 6.1.3 and 6.1.6.1.
