OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: An employee was exposed to struck-by hazards while utilizing a Genie Model S-85 Aerial Lift, Serial Number S8510-008258 on ground that was not level. This resulted in the employee being fatally injured when the machine fell over with the basket raised approximately forty-five (45) feet above the ground. Feasible methods, among others to abate this hazard include but are not limited to:
