OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a) At OC3 on June 26, 2015, and times prior to, employees operated a defective crane. b) At OC3 on June 26, 2015, and times prior to, unqualified employees operated a defective crane. Among other methods, feasible and acceptable methods to correct this hazard include: 1. Correct defects and ensure correction consistent with the National Crane Operators Manual. Defects include but are not limited to an inoperative boom angle indicator, defective remote, an inoperative Jib Stop/bumpers allowing the Jib to travel too low. Additionally, the maximum intended load capacity was not marked on the crane. 2. Conduct daily, weekly and monthly inspections in accordance with the Manitowoc CraneCARE National Crane Maintenance Inspection Manual, page 3 (Daily Inspections); and page 5 (Weekly & Monthly Inspections). 3. Ensure that crane installation and modification are documented and in compliance with the crane manufacturers recommendations. 4. Ensure that operators are qualified to operate the crane and that operators meet the qualifications set forth in the National Crane Operators Manual, Section 2, Para 2-2, Operators Qualifications.
