Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) On or about April 17, 1990, employees were exposed to a falling hazard of approximately 70' and the hazard of being struck by a moving/swaying load being hosited during construction of a building located at 4100 E. MacArthur Dr., Wichita, Kansas. A P & B mobile crane was being used to hoist material (cricket) that was approximately 12' x 5' x 3/16' with a 18" wing attached. The supervisor did not suspend hoisting operations after being advised by the crane operator that the load could not be safely hoisted due to windy conditions. Among other methods, one feasible and acceptable method to correct this hazard is to cease hoisting operations until the safety of the operation is assured as required by Section 5-3.1.3.d, ANSI B30, 5-1968 Safety Code for Crawler, Locomotive, and Truck, Cranes which has been modified by Section 5-3.1.3. ASME/ANSI B30, 5-1989, Safety Standard for Mobile and Locomotive Cranes.
