Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: ...the hazard of being crushed when employees engaged in maintenance and inspection of the 1974 Ford one ton truck with a dump body were exposed to the hazard of being caught between the truck frame and the dump body if the dump body should be accidentally lowered. Among other methods, one feasible and acceptable abatement method to correct this hazard would require that the truck be equipped with a positive means of support, permanently attached and capable of being locked in position to prevent accidental lowering of the body.
