Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death physical harm to employees in that employees were exposed to: The pile driver assembly in use on the south bridge, Illinois Route 48, Weldon, Illinois, was in a poor state of repair in that the metal rungs on the ladder were loose, bent or entirely broken away from the side panels. The employee on this piece of equipment was not tied off while ascending or descending. Some abatement methods which could be used would be: 1) To remove this piece of equipment from the use and replace it with one in a proper state of repair. 2) Repair the piece of equipment in place and continue to use it on this job site. Such repairs should be of a substantial nature to prevent breakage in the future.
