Text For Citation: 02 Item/Group: 001 Hazard: BURNS
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF AN EXPLOSION/FIRE DUE TO THE OVEN BEING USED FOR PURPOSES OTHER THAN FOR WHICH IT WAS DESIGNED. OLD BRASS FOUNDRY, ON OR ABOUT 01/13/95, EMPLOYEES OPERATED THE ACE HEAT CLEANING OVEN TO BURN PAINT WHICH WAS A CLASS 1B FLAMMABLE LIQUID. ACE HEAT CLEANING OVEN SPECIFICALLY WAS NOT DESIGNED TO BURN SOLVENTS, PAINT, AND PAINT SLUDGE (EXCEPT AS CURED COATINGS). AMONG OTHER METHODS TWO FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE TO: 1)UTILIZE AN OVEN THAT COMPLIES WITH NFPA 86-1990. 2)DISPOSE OF PAINTS BY AN ALTERNATIVE METHOD IN ACCORDANCE WITH FEDERAL, STATE AND LOCAL LAW AND REGULATIONS.
