Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer allowed employees to work in surroundings or other work conditions which were hazardous or dangerous to their safety. Among other methods, two feasible and acceptable abatement methods to correct this hazard are providing adequate means to access the upper structure or to enclose the inner portion of the top of the counterweight and guard between the scaffold suspended beneath the counterweights to eliminate possible employee contact with the structural bridge members as the counterweight is moving: a) North Bridge Tower at Top of Counterweight - Employees were exposed to hazards such as being struck by or having arms, legs, head or the body caught between the perimeter of the counterweight and the structural members of the bridge while using the bridge counterweight as an elevator or work platform to access to the upper parts of the structure.
