OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are allowed to operate a Niagara Press Brake with an unprotected foot pedal actuator. Employees are exposed to unexpected machine operation and amputation. a) Lloyd Industries Inc. - The employer allows operation of machinery with an unprotected machine actuator. On or about November 13, 2014, the mechanical foot pedal for the Niagara Model IB-15-3-4 Press Brake was not guarded to prevent accidental operation of the upper die with the employee's hands in the point of operation. The employer's ongoing obligation is to ensure machine actuators are protected and unexpected machine operation does not occur. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to guard the foot pedal in accordance with American National Standard ANSI B11.3-2012.
