29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) At Lot 1 Briargrove Subdivision Mobile, Alabama: On or about November 12, 2014 and at times prior; the employer failed to ensure an extension ladder used by employees to gain access to and from the roof had its rails extend at least three feet above the landing area exposing them to a fall hazard of 9.3 feet to the ground below. THE LUIS MARTINEZ DBA LUIS MARTINEZ WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 743808, CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 20, 2012, WITH RESPECT TO A WORKPLACE LOCATED AT 23951 KILKENNY LANE DAPHNE, ALABAMA.
