29 CFR 1910.1450(e)(3)(iii): The employer's Chemical Hygiene Plan did not include a requirement that fume hoods and other protective equipment functioned properly and did not include specific measures that would be taken to ensure proper and adequate performance of such equipment: a) Laboratory: On or about August 22, 2023, and at times prior, the employer exposed employees to hazardous chemicals, in that the employer did not provide employees with an operational fume hood that did not capture all fumes when required to work with hazardous chemicals, such as but not limited to, Phosphoric and Sulfuric Acid.
