Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:On or About 06/06/11 Location:Building 4 Equipment:Job-Made Work Platform, 31-3/4 Inches Long, 4 Feet Wide, Top Rail 35 Inches Condition:Employees were exposed to falls as great as approximately 30 feet while cleaning the walls from a job-made work platform with deficiencies including, but not limited to, top rails installed 35 inches above the work surface, the entrance lacks midrail protection, means were not provided to attach to the backrest of the forklift, and anchor points not installed by a qualified welder. (b)Date of Violation:On or About 06/06/11 Location:Building 4 Equipment:Job-Made Work Platform, 31-3/4 Inches Long, 4 Feet Wide, Top Rail 55 Inches Condition:Employees were exposed to falls as great as approximately 30 feet while cleaning the walls from a job-made work platform with deficiencies including, but not limited to, means not provided to secure the basket to the backrest of the forklift, and anchor points not installed by a qualified welder. Among other methods, one feasible and acceptable method to correct this hazard, design elevating personnel platforms in accordance with the most recent version of American National Standards Institute (ANSI) B56.1- 2009, Section 5 "Operating Safety Rules and Practices." Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
