29 CFR 1910.1026(j)(3)(ii): The employer did not ensure that bags or containers of waste, scrap, debris, and any other materials contaminated with chromium (VI) and cosigned for disposal were labeled in accordance with the requirements of the Hazard Communication standard, 29 CFR 1910.1200: a) Production Area- Hexavalent Chrome Tank; On or about August 22, 2023, and at times prior, the employer exposed employees to hexavalent chromium hazards, in that the employer did not require employees to dispose of contaminated chromium (IV) towels, nitrile gloves, and other waste in a labeled container after employees batched chromium phosphate and were exposed to hexavalent chromium at an 8-hour TWA level that exceeded the permissible exposure level (PEL).
