29 CFR 1910.119(m)(1): The employer did not investigate each incident which resulted in, or could reasonably have resulted in a catastrophic release of high ly hazardous chemical in the workplace: The employer does not investigate each i ncident which could reasonably have resulted in a catastrophic release of a high ly hazardous chemical in the workplace. Calumet Lubricants did not conduct an in cident investigation of an incident which occurred on May 4, 2010, involving pre ssure vessel, T-101 (tower). The tower was shut down due to a hydrocarbon leak, caused by a small hole in the metal at the top of the vessel. No incident report was completed for this incident. The materials at the top of the tower included light hydrocarbons, which are highly flammable; exposing employees to fire and explosion hazards. Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the abatement date, the employer must submit an abatement plan describing the actions it is taking to en sure that all incidents are investigated.
