29 CFR 1910.119(m)(1): The employer did not investigate each incident which resulted in, or could reasonably have resulted in, a catastrophic release of a highly hazardous chemical in the workplace: b- Hess Port Reading Refinery - Incident investigations were not performed on many releases to flare. Such instances were recorded on the flare events log which include but were not limited to: 06/18/08 - 500 unit main column overpressure with release of 104,598 lbs., 08/05/08 - 600 unit deethanizer tower upset with release of 6,902 lbs., 04/25/06 - 600 unit D-603 upset with release of 67,963 lbs., 12/28/06 2800 unit treater upset with release of 1,917,000 lbs., 01/24/07 - 14pc114 high pressure in treaters with release of 917,463 lbs., 03/24/07 - 2800 unit treater upset with release of 495,231 lbs., 06/21/07 - 600 unit tower upset with release of 57,072 lbs., 08/07/07 SRU MRF shutdown with release of 587 lbs., 10/11/07 - D-2903 upset in C3/C4 splitter with release of 917,463 lbs., 01/15/08 - C2801 RV malfunction with release of 23,109 lbs., 02/05/08 - D-710 By-pass on D-710 left open with release of 3,768 lbs., 02/19/08 - T-603 Back pressure controller transmitter failed with release of 34,532 lbs., 02/23/08 - Line A D-507 Gas Con and Main Column overpressure with release of 39,839 lbs., 02/23/08 - Line B D-507 Gas Con and Main Column overpressure with release 41,512 lbs.
