Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:On or About 03/04/13 Location:Silvering Area Condition:The self-contained emergency eyewash equipment was blocked by a drying rack attached to the wall, was not visually checked and the fluid changed since September 2009 when the manufacturer recommended the fluid be changed every 90 days while employees were exposed to hydrochloric acid and bleach, both corrosives, while silvering the glass. (b)Date of Violation:On or About 03/05/13 Location:Assembly Area Condition:The self-contained emergency eyewash equipment was not visually checked and the fluid changed since September 2009 when the manufacturer recommended the fluid be changed every 90 days while employees were exposed to ammonium hydrogen fluoride and hydrochloric acid, both corrosives, while working in the lab. Among other methods, one feasible and acceptable method to correct the hazard is to comply with the American National Standard for Emergency Eyewash and Shower Equipment, ANSI Z358-2009. The path of travel was not free from obstructions and eyewash units were not visually checked to determine if flushing fluids need to be changed or supplemented.
