Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of possible falling under a moving railroad car while they are attempting to mount it because the riding stirrups were defective or missing: a) Iron and Transporation Division 1) Transportation Department - Track #RA-2 - North Yard Area - Rail car #3326 had defective or missing riding stirrups, observed August 29, 1989. 2) Transportation Department - Track #R2-9 - Bridge Yard - Rail car #2584 had defective or missing riding stirrups, observed August 29, 1989. 3) Transportation Department - Track #W-4 - W-Yard - Rail car #8647 had defective or riding stirrups, observed August 31, 1989. 4) Transportation Department - Track #W-5 - W-Yard - Rail car #38569 had defective or missing riding stirrups, observed August 31, 1989. 5) Transportation Department - Track #W-6 - W-Yard - Rail cars #2596, #7389 and #1953 had defective or missing riding stirrups, observed August 31, 1989. b) Steel Producing Division 1) Open Hearth Department - Track #H-9 - Open Hearth Yard - North End - Rail car #2618 had defective or missing riding stirrups, observed August 29, 1989. 2) Open Hearth Department - Track #H-12 - Stock House Yard - South End - Rail cars #2604 and #2314 had defective or missing stirrups, observed August 28, 1989. Abatement Note: One feasible and useful means of abatement among other methods, would be for the company to implement and enforce a safety appliance repair program to ensure rail cars are not used unless they are free from defects that may cause employees to become injured.
