North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Struck By/ Crushed By / Thermal Burns due to the explosive effects of natural gas where work was performed on pipes containing natural gas and lighting used was not limited to listed safety-type flashlights and safety lamps. a)Pump room #2 at ConAgra plant in Garner, NC- on or about 6/9/09, an employee was attempting to light the "Maxi-Miser" on demand natural gas and propane fired water heater system. The employee removed and replaced a pressure gauge in the active 3/8" pilot gas line with the aid of a temporary incandescent light strand that was not listed as safety type. Reference: [ NFPA 54 Chapter 4.3.1(4) (2002 version): Potential ignition sources. Where work is being performed on piping that contains or has contained gas, artificial illumination shall be restricted to listed safety-type flashlights and safety lamps.] Abatement Note: One means of abatement would be to disable all un-rated lighting and replace them with temporary lighting that is intrinsically safe or rated for an explosive atmosphere during the gas line work process.re
