29 CFR 1926.1211(b)(4): The employer did not ensure that affected employees practice making permit space rescues before attempting an actual rescue, and at least once every 12 months, by means of simulated rescue operations in which they remove dummies, manikins, or actual persons from the actual permit spaces or from representative permit spaces: (a) On or about 12/02/2021 at 35 Frankfort Street New York, NY 10038, employees who provided rescue in a permit required confined space located at Arch Block E Span 15 were not provided simulated rescue operations training by the employer. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
