1910.38(c)(3) Procedures to be followed by employees who remain to operate critical plant operations before they evacuate; Establishment: On or about December 19, 2022, the employer's emergency response plan for emergencies involving employees who respond to investigate and or troubleshoot ammonia releases did not adequately address the following minimum requirements of this standard including, but not limited to, 1910.120(q)(2)(vii) "Decontamination", 1910.120(q)(2)(ix) "Emergency alerting and response procedures" , 1910.120(q)(2)(x) "Critique of response and follow-up" and 1910.120(q)(2)(xi) "PPE and emergency equipment". Or in the Alternative: 29 CFR 1910.38(c)(3): The emergency action plan did not include the procedures to be followed by employees who remain to operate critical plant operations before they evacuate: On or about December 19, 2022, the emergency action plan did not include adequate procedures to be followed by employees who remain to operate critical plant operations before they evacuate in that the plan did not specify how employees would evaluate the ammonia levels in their workplace and be provided with appropriate personal protective equipment such as respirators.
