29 CFR 1910.134(h)(3)(i)(B): The employer did not ensure that respirators maintained for use in emergency situations had been inspected for proper function before and after each use or at least monthly and in accordance with manufacturer recommendations: ALON USA, LP, 200 Refinery Road, Big Spring, TX. The employer does not ensure all respirators maintained for use in emergency situations are inspected after each use to ensure each was fully functional. This violation was observed on or about April 15, 2009 in the following instance: Self-Contained Breathing Apparatus (SCBA) are not inspected after use and prior to replacing in storage areas identified as containing SCBAs for use in emergency situations. SCBA storage bins on the north and south sides of North Side Control Room. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure respirators maintained for use in emergency situations are inspected at least monthly and in accordance with manufacturer recommendations.
