Text For Citation: 01 Item/Group: 016 Hazard: REFINERY
29 CFR 1910.120(q)(1): Employers whose employees were engaged in emergency response did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations: ALON USA, LP, 200 Refinery Road, Big Spring, TX. The employer does not ensure all emergencies are identified in their written emergency response plan. This violation was observed on or about April 15, 2009 in the following instance: The employer does not have as a part of its Emergency Response Plan (ERP), a written plan-of- action regarding potential situations which can be initiated by external forces such as trains. A rail line runs west to east across the property of the refinery effectively dividing the refinery units in half, thus the use of the designation North side and South side. The inherent hazard associated with rail transportation is opportunity of derailment or rail cars loaded with highly hazardous chemicals (HHC's). Rail consignments include HHC's and explosives such as, but not limited to: WASTE POLYCHLORINATED BIPHENYLS; CARTRIDGES FOR WEAPONS; ROCKETS; PROJECTILES; CHARGES, DEMOLITION; WEAPONS; FIREWORKS, ANHYDROUS AMMONIA, 1,1,1,2-TETRAFLUOROETHANE; PRESSURIZED PNEUMATIC ARTICLES; COMPRESSED GAS; OXIDIZING, N.O.S.; PENTAFLUOROETHANE; etc. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking in the workplace to develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations.t
