29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program including the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (a)On or about July 7, 2016, the employer failed to develop and implement a hazard communication program compliant with the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii). The hazard communication program does not include information required to be compliant with the globally harmonized system (GHS) including but not limited to formatting of Safety Data Sheets (SDS), Signal Words, Pictograms, and Container Labeling. The hazard communication program has not been implemented in that employees have not received training, and the hazard communication program has not been reviewed or updated since a date prior to required compliance with the globally harmonized system. Employees are exposed to chemical hazards including, but not limited to Elgen Water Based Liner Adhesive, Capital Hardware Elgen 100% Silicone Sealant and Adhesive, Elgen Duct Sealer, 10555 Spiral Lube QD, and OEM/Mechanical - CT10101-5 insulation material, and fumes/particles generated from welding and cutting galvanized steel.
