Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: API 653 - April 2009 Cover steel storage tanks built to API 650 and its predecesor API 12C. It provides minimum requirements for maintaining the integrity of such tanks after they have been placed in service and addresses inspection, repair, alteration, relocation, and reconstruction. a)At Caribbean Petroleum Refining in Bayamon (CAPECO), employees that worked performing routine task such as tank operator,waste treatment operator,loading rack operator, among others were or could be exposed to flammable and combustible release, fire and or explosion during the performance of there duties. At the tank farm area the employer did not inspected all atmospheric tanks in which they stored gasoline,jet fuel, fuel oil, and diesel in above ground tanks, ranging from 500 to 500,000 barrels to ensure the integrity of such tanks after they have been placed in service. See Binder 3 tab 2b OSHA PRODUCTION No.2 11/20/09 Monthly inspection Checklist for Bulk Storage Tanks page 356, 359, and 362. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow API 653 - 6.4.1.2 All tanks shall have a formal internal inspection conducted at the intervals defined by 6.4.2. The authorized inspector who is responsible for evaluation of a tank must conduct a visual inspection and assure the quality and completeness of the nondestructive examination (NDE) results. If the internal inspection is required solely for the purpose of determining the condition and integrity of the tank bottom, the internal inspection may be accomplished with the tank in-service utilizing various ultrasonic robotic thickness measurement and other on-stream inspection methods capable of assessing the thickness of the tank bottom, in combination with methods capable of assessing tank bottom integrity as described in 4.4.1. Electromagnetic methods may be used to supplement the on- stream ultrasonic inspection. If an in-service inspection is selected, the data and information collected shall be sufficient to evaluate the thickness, corrosion rate, and integrity of the tank bottom and establishthe internal inspection interval, based on tank bottom thickness, corrosion rate, and integrity, utilizing the methods included in this standard. An individual, knowledgeable and experienced in relevant inspection methodologies, and the authorized inspector who is responsible for evaluation of a tank must assure the quality and completeness of the in-service NDE results. API 653 - Abril 2009 Abarca tanques de almacenamiento de acero construidos de acuerdo al API 650 y su antecesor API 12C. Este provee requisitos minimos para el mantenimiento de la integridad de dichos tanques despues de haber sido puestos en servicio y trata inspecciones, reparaciones, alteraciones, relocalizaciones y reconstrucciones. a)En "Caribbean Petroleum Refining" en Bayamon (CAPECO), empleados que trabajaban realizando tareas rutinarias tales como operador de tanque, operador de tratamiento de aguas, operador de area de carga, entre otras fueron o podrian estar expuestos a liberacion de productos quimicos inflamables, combustible, fuego y/o explosion durante el desempeno de sus deberes. En la granja de tanque el patrono no inspecciono todos los tanques atmosfericos, donde se almacenaba en tanques sobre el terreno gasolina, diesel, aceite combustible, combustible para aviones con capacidades que fluctuaban de 500 a 500,000 barriles para garantizar la integridad de estos tanques luego de haber sido puesto en servicio. Un metodo seguro entre otros metodos aceptables para corregir estos riesgos son: 1.Seguir el API 653 - 6.4.1.2 Todos los tanques deben tener una inspeccion interna formal conducida a los intervalos definidos en 6.4.2. El inspector autorizado el cual es responsable por la evaluacion del tanque debe conducir una inspeccion visual y asegurar la calidad e integridad de los resultados de las pruebas no destructivas (NDE). Si la inspeccion interna es requerida solo para el proposito de determinar la condicion e integridad de la base del tanque, la inspeccion interna puede ser realizada con el tanque en servicio utilizando varias medidas de espesor ultrasonicas robotizadas y otros metodos de inspeccion en secuencia capaces de evaluar el espesor del fondo del tanque, en combinacion con metodos capaces de evaluar la integridad del fondo del tanque como descrito en 4.4.1. Metodos electromagneticos pueden ser usados para complementar la secuencia de la inspeccion ultrasonica. Si se selecciona una inspeccion en servicio, la data e informacion recopilada debe ser suficiente para evaluar el grosor, la razon de corrosion y la integridad del fondo del tanque y establecer losintervalos de inspeccion interna, basado en el grosor del fondo, razon de corrosion e integridad, utilizando los metodos incluidos en este estandar. Un individuo conocedor y con experiencia en las metodologias de inspeccion pertinente y el inspector autorizado el cual es responsable para la evaluacion del tanque debe asegurar la calidad e integridad de los resultados NDE en servicio.s
