Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:04/23/13 Location:Throughout the Storage Yard and at the Storage Sheds, Work Sheds, and Work Shops Equipment:CAT-RC60 Forklift Condition:The forklift was operated without a seatbelt. (b)Date of Violation:04/23/13 Location:Throughout the Storage Yard and at the Storage Sheds, Work Sheds, and Work Shops Equipment:Ford Forklift, Model-MC-843-8F, Serial #-1505 Condition:The forklift was operated without a seatbelt. (c)Date of Violation:04/23/13 Location:Throughout the Storage Yard and at the Storage Sheds, Work Sheds, and Work Shops Equipment:Datsun 7000 Forklift, Model-YF03A33TV, Serial #-YF03-000717 Condition:The forklift was operated with the seatbelt wrapped up under and behind the seat so it could not be used. (d)Date of Violation:04/23/13 Location:Throughout the Storage Yard and at the Storage Sheds, Work Sheds, and Work Shops Equipment:Nissan 90 Forklift, Model-WGF03H40V, Serial #- WGF03-921307 Condition:The forklift was operated without a seatbelt. Among other methods, one feasible and acceptable method to correct this hazard, utilize and install the restraint system in accordance with the current version of American Standards Institute (ANSI) B.56-2011 "Safety Standard for Low Lift and High Lift Trucks" and American Society of Mechanical Engineers (ASME) B56.1-2000 "Safety Standard for Low Lift and High Lift Trucks". Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
