29 CFR 1910.132(a): Protective equipment, including personal protective equipmen t for eyes, face, head and extremities, protective clothing, respiratory devices , and protective shields and barriers were not provided, used, and maintained in a sanitary and reliable condition whenever it was necessary by reason of the hazards of process or envir onment, chemical hazards, radiological hazards, or mechanical irritants encounte red in a manner capable of causing injury or impairment in the function of any p art of the body through absorption, inhalation or physical contact. The employer does not require employees to wear seat belts while driving or riding motor veh icles, such as, but not limited to Ranger 2X4 carts, on refinery roads. This vio lation was observed on or about May 10, 2010 in the refinery complex where emplo yees used a Polaris vehicle Number 2604 (Vehicle Identification Number 4XARBSOA3 97208534). and a Mule 600 Kawasaki (Model Number KAF4008) without wearing the se atbelt to get around the facility. Employees are exposed to the hazard of being struck by equipment or from impact hazards if dislodged from the vehicle's seat. Pursuant to 29 C. F. R. 1903.19, within ten (10) calendar days of the date of th is citation, the employer must submit documentation that it is in compliance wit h the standard, including describing the steps it is taking to ensure employees are not exposed to this struck-by equipment or impact hazard. One method of abat ement among others is to clean the seat belts provided and use them as required by the warning label posted on the dashboard. Orange or brightly colored seat be lts and/or covers can aid in the enforcement of this standard by making their us e more visible from a distance.
