29 CFR 1910.119(l)(1): The employer did not establish and implement written procedures to manage changes to process chemicals, technology, equipment, and procedures; and, changes to facilities that affect a covered process: ALON USA, LP, 200 Refinery Road, Big Spring, TX. The employer does not establish a Management of Change (MOC) procedure when a temporary structure is located / placed in the area of or near a covered process. This violation was observed on or about April 15, 2009, including, but not limited to the following areas: a) "Sea containers" located on the south side of the Alky unit in production.. b) Skid mounted structures used for storage are located throughout the facility with some actually inside the units. c) Mobile offices placed on the east side of the facility to accommodate guest contractors offices, within as little as 100 feet of a finished product storage tank. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking in the workplace to establish and implement written procedures to manage changes to process chemicals, technology, equipment, and procedures; and, changes to facilities that affect a covered process.
